TRADEMARK

Trademark Registration

A trademark is an innovative form of intellectual property that encompasses a distinct sign, design, or expression, enabling the identification of services or products originating from a specific organization, individual, or source. It serves as a symbol of authenticity and can be registered by diverse legal entities. Placed on labels, vouchers, packages, or the products themselves, trademarks embody corporate identity and are often prominently showcased on company premises. These exclusive marks safeguard against unauthorized usage by others, preserving the unique identity and reputation of brands.

Since its inception in 1940, the Trade Marks Registry has played a pivotal role in India’s intellectual property landscape. Currently overseeing the Trade Marks Act of 1999 and its associated regulations, this esteemed organization serves as a valuable resource and information hub for all trademark-related matters within the country. From registration to enforcement, the Trademark Registry acts as a guiding force, nurturing a robust trademark ecosystem in India.

When you see ‘TM’ or ‘SM’ on a logo, it indicates the company’s exclusive ownership of the trademark or service mark, respectively. These symbols are reserved for those who have filed trademark applications.

After successfully registering a trademark with the Trademark Authority and having it published in the official gazette, individuals are entitled to use the copyright symbol (©) for the same. This symbol signifies legal protection and ownership of the trademarked work.
